Terms of Service

These Terms of Service ("Terms") govern your access to and use of Convia ("Service"), operated by Zaftech ("Zaftech", "we", "us", "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Convia is a software platform that converts documents and structured inputs into AI-powered conversational forms, and collects and analyzes the resulting submissions on behalf of account holders.

2. Accounts

You must provide accurate information when registering and keep your credentials secure. You are responsible for all activity under your account. Notify us at contact@zaftech.co if you suspect unauthorized use.

3. Acceptable use

You agree not to use the Service to:

  • Violate any law, regulation, or third-party right;
  • Upload malicious code, attempt to breach security, or reverse-engineer the Service;
  • Collect data in ways that violate the privacy rights of respondents;
  • Harass, defraud, or deceive respondents or other users;
  • Resell, sublicense, or provide the Service to third parties without our written consent.

4. Your content

You retain ownership of the forms you create and the data your respondents submit ("Customer Data"). You grant Zaftech a limited license to process Customer Data strictly to provide and improve the Service, and only for the duration of your account. We never sell Customer Data.

You are solely responsible for the lawfulness of Customer Data, including obtaining any consents required by applicable privacy law (GDPR, CCPA, etc.).

5. AI processing

Convia uses third-party AI providers (including Google) to power conversational and analytical features. By using the Service, you authorize us to transmit Customer Data to those providers as necessary. See our Privacy Policy for details.

6. Fees

Paid plans are billed as stated on the pricing page. Fees are non-refundable except where required by law. You can cancel a paid plan at any time; access continues until the end of the billing period.

7. Intellectual property

The Service, including its software, design, and trademarks, is owned by Zaftech and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. See our License for the proprietary terms governing the software.

8. Third-party services

The Service integrates with third parties (for example, Google Gemini, email providers, object storage). We are not responsible for the availability or terms of those services. Your use of them is governed by their respective terms.

9. Termination

You may delete your account at any time. We may suspend or terminate access if you violate these Terms, if required by law, or if the Service is discontinued. Upon termination, your right to use the Service ends immediately. Customer Data export is available for 30 days after account deletion.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. Zaftech does not warrant that the Service will be uninterrupted, error-free, or that AI outputs will be accurate. You are responsible for validating results that drive consequential decisions.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Zaftech's aggregate liability for any claim arising out of or relating to the Service shall not exceed the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

12. Indemnification

You agree to indemnify and hold Zaftech harmless from any claim, loss, or expense arising from your use of the Service, your Customer Data, or your violation of these Terms.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-product notice. Continued use after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws applicable to Zaftech's principal place of business, without regard to conflict-of-law principles. Any disputes will be resolved in the competent courts of that jurisdiction.
